The new directive issued by the Trump Administration has toughened the rules for the non-immigrant visas such as H1B and L1, which are more popular among Indian IT professionals by making clear that the burden of proofs lies solely on the applicant during the renewal process.

The US Citizenship and Immigration Services has asserted that to produce the proofs for establishing eligibility is on the petitioner, making change in the previous policy of 2004 that the burden lies on the Federal Agency.

According to the new rule, the petitioner will have to produce the proofs every time to establish the eligibility to the Federal Agency so that the visa can be renewed. This is a full 360 degree change from the previous policy, in which the Federal Agency used to provide the extension to the visa to the people, which are eligible for the renewal process.

The change is not only applicable to the new applicants but also to the already existing people in the country.

The move has made under the President Trump’s America First policy and to protect the American workers from any discrimination along with helping in cracking down on visa abuse as well as fraud.
