Following the implementation of the Trump administration, there has been a very rough time for people to get their H-1B visa approved. If reports are to be believed, it suggests that over fourth of all the new applications for the H-1B visa has been rejected by the Trump administration till date. The same is through the third quarter of the financial year of 2018-19.

According to one of the conducted analysis of H-1B data from the US Citizenship and Immigration Services (USCIS), it suggests that the rate of rejection has tripled in the financial year of 2019 in comparison to what it was in 2015.

The Indian nationals are believed to include around 70% of the H-1B permit holders mainly because of the requirements of the MNCs for talents to work on site.

Stuart Anderson, executive director of National Foundation of American Policy suggested saying, “The denial rates for H-1B petitions have increased because USCIS has changed the standards for approval without new regulations or Congress passing a new law.”

The denial rates for the H-1B visa during the FY15 for the fresh applications were at a mere 6%.

Further emphasizing on the same, Anderson suggested saying, “The denial rate for initial employment, primarily for new employees, has increased for nearly all leading companies but it’s clear USCIS adjudicators have singled out information technology services companies for the most restrictive policies.”

In the year of 2018, the top six firms in India could secure just 16%, which included 2,145 H-1B visa permits which was a lot less than what Amazon could secure for their employees.

Some further analysis done by NFAP suggests that Apple, Cummins and Walmart are the three brands who have not experienced any kind of changes in their degree of rejection under the analysis conducted between the top 27 companies.

Several of the immigration experts suggest that these blows and rejections to the H-1B visa permits could affect the talent movement alongside the business progress of some of the tech giants across the nation.

A managing partner from an immigration law firm suggested saying that this sharp increase in the denials can end up causing a lot of problems if the same isn’t handled within time. The rate has consistently been going up and that is something that’s quite alarming at this point.

One of the NFAP analysis also reported, “The denial rate of 12% for continuing employment (average of continuing petitions for 27 companies) in FY19 is four times higher than the denial rate of only 3% for such petitions in FY2015.”

Following coming into power, President Trump has been consistently focusing on the immigration form reforms and some of the Indian IT firms have been taking the blow of the same.

In addition to that, the United States has also issued a new law suggesting that the candidates who have an US master’s degree are more likely to be eligible for the work permit. Whether the same will prevail around the H-1B Visa requests is something that people have to wait and see.
