Fraud-In-Flat-Sale

With the constant investments in real estate that the NRIs are indulging in, Bahrain based NRI, Ashis Rathour did have a completely different experience. He filed a complaint against the developers of Empress City of fraud at the Prime Minister’s Office along with the Ganeshpeth police station. The police are currently investigating the case.

The developers have denied all the allegations and accusations made against them and have also stated that they are going to work to resolve all the issues pretty soon.

Rathour is from Balaghat which is why he registered the police complaint at the Ganeshpeth police station on October 11 which was then forwarded to the Prime Minister’s Office on October 20. Addressing the situation, Rathour stated saying, “I planned to settle in Nagpur after retirement. I came to know about Empress City and booked a flat costing Rs. 54.40 lakh. I paid 25% of the amount and received allotment letter on August 26, 2010.”

The allotment letter that Rathour received was issued by Reward Real Estate Co. Ltd and not the actual KSL developers who were undertaking the project. Further clarifying the points, Rathour said that the developers asked him to pay the other 85% of the payment for the flat when he kept following up with the developers consistently. He was promised the flat within 2 years. After getting the answer, Rathour also paid the remaining 85% in 2017 and 2018. He said that he was supposed to pay the remaining amount after getting the possession of the flat and the signing of the sale deed.

For better acquiring of the flat, Rathour even stayed in Nagpur for an extended 15 days till July 23rd. But, the agreement of sale was again delayed because of certain reasons.

Throwing some light on the situation back then, Rathour stated saying, “The developer knew I was to return on July 23, so they called me on that day. They did not allow me to read the document before registering it at the registrar’s office. They assured me the flat, area, cost, sanctioned plan etc were as per allotment letter. I signed the document and took a copy and flew back. After reaching, I read the agreement to sale and realized I was cheated.”

In the initial stage, Rathour was promised with the flat number DZ 308 in the Dreamz Wing according to what was mentioned in the allotment letter. But, he found in the agreement to sale that it mentions some flat no. 304 and even the difference in the name of the seller to Kaushal Logistics Pvt. Ltd. The sanctioned plan that came with the allotment letter and the one with the agreement were completely different.

Further stating, Rathour said that he was shocked with the changes in the agreement and the allotment papers. The developers have also apparently assured him time and time that the agreement would be revised when he would visit Nagpur. He visited Nagpur in October but the developer wasn’t able to give him a copy of the sanctioned plan along with the copy of the agreement. He said that he had no other options but to lodge a complaint following the developers cheating him.

PI Shivram Kumbhre stated that he has already filed the complaint and the investigation has already started.

Addressing the dispute, Kumbhre issued a statement saying, “We sent letters to registration department and some more places seeking information. It seems to be a civil matter and related to RERA. But we are investigating and will take necessary action about the situation.”

Pravin Tayal, who is the developer of the Empress City stated saying that all the allegations by Rathour are a complete hoax and everything will be resolved soon. He clarified saying, “Rathour is bargaining for a bigger flat, which is under consideration. We executed agreement to sale with him and will give possession of flat. Rathour is yet to pay entire amount. The scheme n which Rathour was given flat is sanctioned by competent authority.”
